Challenges


The following problems regarding the objectives and activities of non-governmental organisations exist:

  • particular legal restrictions on the permitted objectives and activities of non-governmental organisations are not always consistent with entitlements under universal and regional human rights norms;
  • not all the grounds recognised as the basis for refusing registration or the grant of legal personality to non-governmental organisations are drawn with sufficient precision;
  • there is sometimes an unjustified confusion of proposals to change the law with an intention to breach it;
  • there is a tendency for conclusions about the admissibility of the objectives of non-governmental organisations to be based on unfounded apprehensions and suppositions; and
  • the inadmissible activities of officers and members of non-governmental organisations are sometimes unjustifiably attributed to the organisations themselves
