The following problems regarding the capacities that should be enjoyed by non-governmental organisations exist:

  • the failure to grant legal personality where this is sought in a timely and non-arbitrary manner;
  • the need for approval as to scope of a non-governmental organisation's scope of operations both initially and where any subsequent change is proposed; and
  • official support, whether by law or other measures (including inaction), for efforts to discourage or prevent non-governmental organisations from pursuing their objectives
