The following problems regarding the property and income of non-governmental organisations exist:

  • undue restrictions on the sources of funding that can be exploited and in particular it is not possible to undertake economic activities and receive grants from abroad either at all or without considerable difficulty;
  • excessive levels of taxation on any income received;
  • an inability to open bank accounts;
  • a lack of standing to bring proceedings to protect property interests;
  • overformalistic requirements regarding the use of income received going beyond any conditions imposed by donors; and
  • confiscation of assets following enforced dissolution that is incompatible with international and regional human rights norms.
